Non-profit organization Better Markets has submitted a legal document, known as an Amicus brief, in support of the US Securities and Exchange Commission (SEC) in its lawsuit against Ripple Labs Inc. Better Markets presented three specific arguments to support the SEC's claim that XRP, a digital asset sold by Ripple, meets the criteria outlined in the Howey test, which determines whether a financial instrument is considered a security.
