Inroduction; Welcome to CandleFocus.com! Our website and mobile application (collectively, the "Platform") provide you with access to a variety of content, features, software, and applications (collectively, the "Service"). These Terms of Use (the "Terms") govern your access to and use of our Platform and Service. By accessing or using our Platform and Service, you agree to be bound by these Terms. Eligibility; In order to access or use the Service, you must be at least of legal age in your respective jurisdiction. The Service is intended for personal, non-commercial use only. If you wish to use the Service for commercial purposes, you must enter into a separate agreement with us. If we have previously terminated any account of yours or banned you from using the Platform or Service, you are not permitted to access or use the Service.

Account; In order to use some parts of the Service, you will need to create an account with CandleFocus ("Account"). When creating an Account, you represent and warrant that you are at least of legal age in your respective jurisdiction, capable of entering into legally binding contracts, and that all information provided is accurate, up-to-date, truthful, and complete.

You are solely responsible for all activities conducted under your Account. CandleFocus will not be held responsible in any way if your password and/or Account are misappropriated or used by a third party. You are responsible for keeping your password secure and your account information up-to-date at all times.

Unless expressly permitted by CandleFocus and subject to the Terms, you are prohibited from setting up multiple Accounts. You may not lend, transfer, or sell your Account or account information to another party and must not use another user's Account without their written permission.

CandleFocus may occasionally contact you at the email address provided in your Account registration. You will not be able to opt-out from such communications and you shall take the responsibility to ensure that your email address is up-to-date. If you missed any communications due to an inaccurate, outdated, or incomplete email address, CandleFocus will not be liable for any losses or damages caused by you missing the communication.

License; The Service and all Content provided through the Service are protected by copyright and trademark laws, and are the property of CandleFocus OpCo, LLC (CF) and its third-party licensors and suppliers. By using the Service, you are granted a limited, personal, non-exclusive, non-sub-licensable and non-transferable license to access and use the Content and Service for your personal use only. You may not use the Service or any Content for any commercial purpose.

You agree to protect the proprietary rights of CF and all others with rights in the Service and to comply with all written requests made by CF to protect its and others' contractual, statutory, and common law rights in the Service.

You may not modify, edit, copy, distribute, reproduce, publish, display, perform, license, sell, rent, lease, loan, create derivative works of, create any index, reverse engineer, alter, enhance, or in any way exploit the Service or the Content in any manner.

If you breach any of these Terms, the license granted to you will terminate automatically.

Prohibited Activities; The Service and all Content provided by CF are protected by copyright and trademark laws and are the property of CF and its third-party providers. Any use of the Service or Content other than as expressly permitted by these terms is prohibited.

Prohibited activities include, but are not limited to:

• Copying, modifying, or creating derivative works of the Service or any Content.
• Copying, manipulating, or aggregating any Content for the purpose of making it available to any third party.
• Trading, selling, renting, loaning, leasing, or licensing any Content or access to the Service, whether commercially or free of charge.
• Using or introducing to the Service any data mining, crawling, "scraping", robot, or similar automated or data gathering or extraction method, or manually accessing, acquiring, monitoring, or copying any portion of the Service, or downloading or storing Content (unless expressly authorized by CF).
• Making excessive requests for information or taking any action that interferes with, disrupts, or imposes an undue burden on the Service or any server or network connected to the Service or negatively affects the quality or availability of any Content, or speed or functionality of the Service.
• Introducing a virus, Trojan horse, worm, time bomb, or other malware to the Service or the Platform, or using any device, software, or routine to bypass any software or hardware that prohibits volume requests for information.
• Violating, bypassing, or circumventing any security measure intended to limit or prevent access to the Platform, Content, or Service.
• Attempting to gain unauthorized access to the Service, any Content, or to any computer systems or networks connected to the Service or any CF server, whether through hacking, password mining, unauthorized use of another's password/credentials, or any other means.
• Restricting, inhibiting, or interfering with the use of the Service by any other user (including by hacking or defacing the Platform).
• Introducing or otherwise distributing through the Platform any computer program that damages, interferes with, intercepts, collects, releases, or discloses any system, data, or personal information of CF or any third party.
• Making use of any of CF's trademarks, service marks, trade names, or logos or those of any third party displayed on the Platform.
• Modifying or removing any copyright or other proprietary notice in the Content.
• Using the Website, Content, or Service for or in connection with any activity that violates any applicable law, statute, ordinance, or regulation, including without limitation, the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), or involves proceeds of any unlawful or illegal activity.
• Any violation of these prohibited activities will result in the termination of the license granted to use the Service and Content.

Ownership; According to these terms, viewing, printing, and making copies of the Content for personal use is permitted. However, any other usage, reproduction, downloading, "screen scraping," storage, transmission, broadcasting, modification, creation of derivative works, display, performance, distribution, redistribution, selling, licensing, renting, leasing, or exploitation of any Content, in whole or in part, that does not comply with these terms without prior written permission from CF is prohibited. CF owns or controls all Content. The CF logo and all other product or service names or slogans displayed on the Service are registered and/or common law trademarks of CF or its suppliers or licensors and may not be copied, imitated, or used, in whole or in part, without the prior written permission of CF or the applicable trademark holder. The look and feel of the Service, including all page headers, custom graphics, button icons, and scripts, is the service mark, trademark, and/or trade dress of CF and may not be copied, imitated, or used, in whole or in part, without the prior written permission of CF. All other trademarks, registered trademarks, product names, and company names or logos mentioned in the Service are the property of their respective owners. Reference to any products, services, processes, or other information, by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation thereof by CF.

These terms do not grant any interest in any of CF's or any third-party's intellectual property. The use or misuse of CF's trademarks or other intellectual property, except as expressly permitted by these terms, is prohibited. If any violation or infringement of CF's or its providers' intellectual property rights is known or suspected, CF must be promptly notified at legal@candlefocus.com.

"Candlefocus" and all related logos, trademarks, service marks and trade names are solely the property of CF. The absence of a name, logo or other mark herein does not constitute a waiver of any and all intellectual property rights that CF has established. Other trademarks, names or logos used on the Website are property of their respective owners. The use of any of these without authorization is prohibited.

It is acknowledged that CF and/or its providers own the copyright in and to all Content under the applicable laws (including copyright laws and other intellectual property laws), and have reserved all rights in and to such Content.

Community Generated Content; According to these terms, users of the Service may post and share various types of content, including texts, images, videos, predictions, and other materials. However, users are fully responsible for the content they provide and must ensure that it is legally compliant with all applicable laws, rules, and regulations.

Users acknowledge that by using the Service, they may be exposed to content that is offensive, inaccurate, misleading, or otherwise inappropriate. The person or party who posted such content is solely responsible for it and candlefocus is not liable for any community-generated content.

candlefocus reserves the right to remove any community-generated content at its discretion if it violates these terms, if a complaint or notice of infringement is received, or if the content is otherwise objectionable. Additionally, any community-generated content posted should not be considered as financial advice, and users accept full responsibility for any risks associated with using such content.

Before posting any community-generated content, users must ensure that they own or are licensed to the intellectual property rights in such content. If they suspect that other community-generated content has infringed their intellectual property rights, they should report it to candlefocus at legal@candlefocus.com.

Users retain ownership rights in the content they post on the Platform, but grant candlefocus a worldwide, fully-paid, royalty-free, sub-licensable, and transferable license to use, display, reproduce, modify, adapt, edit, publish, and distribute such content for the purpose of operating, developing, providing, promoting, and improving the Service, and for researching and developing new products and services. candlefocus is not obligated to make any compensation to users for the content they submit or post on the Platform. Users acknowledge that their use of the Service is sufficient compensation for the content they submit or post on the Platform and the grant of rights herein.

Disclaimers and Limitation of Liability; The Content provided on the Service is for informational purposes only and should not be considered as investment advice or recommendations. CF does not review all Content for accuracy, completeness or reliability and does not warrant or guarantee the accuracy, completeness, reliability or any other aspect of any Content. Content on the Service may not be used as a basis for any financial product or other product without the express prior written consent of CF. The Service and Content may include inaccuracies or errors and CF does not guarantee the accuracy, completeness, timeliness, security, availability or integrity of the Service or any Content. By using the Service, you agree that CF will not be responsible or liable, directly or indirectly, for any goods, services, information, resources, and/or content available on or through any third-party website or services, for any dealings or communications you may have with third parties, or for any harm, damages, or loss caused or alleged to be caused by or in connection with any of the foregoing or your use of or reliance on the materials or the content or business practices of any third party.

Modification of the Website & Terms; CF reserves the right to make changes to the website, including but not limited to the service and content, at any time without prior notice. These modifications, suspensions, or discontinuations can be made for any reason and CF will not be held liable for any resulting consequences to you or any third party.

We reserve the right to modify these Terms at any time and without prior notice. You are bound by any modifications to these Terms once we post them to the Service. You should frequently review these Terms to ensure familiarity with the most recent version.

Enforcement; In the event of a violation or suspected violation of these Terms, CF reserves the right to take any necessary actions to protect its interests. Such actions may include, but are not limited to, suspending, terminating or blocking your access to the Service, without prior notice to you. Your violation of these Terms shall be considered a breach of contract. CF also reserves the right to investigate any suspected violations of these Terms or any misuse of the Service. As part of this investigation, CF may report any activity or information to relevant law enforcement authorities, financial regulators, internet service providers, and third-party vendors. This may include, but is not limited to, providing information such as your email address, IP address, or other identifying information. CF may also disclose any information deemed necessary to comply with applicable laws, regulations, or legal requests. Please note that CF's remedies are cumulative and in addition to any others available to CF.
