The U.S. Securities and Exchange Commission (SEC) may undergo a significant policy change regarding cryptocurrencies as it faces a leadership transition. SEC Commissioner Hester Peirce hints at a potential shift towards a more innovation-friendly approach. With a new SEC Chairman set to take over on January 20, 2025, Peirce expresses optimism about the agency's future. Key areas for reconsideration include cryptocurrency exchange-traded funds (ETFs) and staking for Ethereum-based ETFs. Peirce also suggests broader regulatory reforms, potentially allowing the Commodity Futures Trading Commission (CFTC) to play a larger role in overseeing certain crypto markets. The SEC may issue clearer guidance through no-action letters or exemption orders, and reevaluate whether certain transactions qualify as securities to reduce regulatory overreach.
