Bait and Switch

Bait and switch is an unethical consumer practice that entices shoppers with attractive deals only to switch the offer to a different, more expensive item. This technique is used by many businesses to raise the price of goods beyond what the consumer has agreed to pay, or to make extra money when a deal is too good to be true. It is illegal in many jurisdictions and should be avoided whenever possible.

The first step in a bait and switch is to advertising an irresistible offer. Many businesses use this method to draw in shoppers and create a sense of urgency for limited stock or exclusive discounts. This offer is then widely advertised across different media outlets, from newspapers and magazines to online stores and social media platforms.

Once the target consumer is enticed by the offer and visits the store or website, they are then presented with an upsell. This process involves selling a product of inferior quality or specification to the advertised item, or no item at all. Instead, the consumer is pressured to accept an offer of a more expensive item. This technique forces buyers to accept the higher-priced product when the advertised deal is no longer available.

Legally, bait and switch is often considered a false advertising or unfair trade practice. In many jurisdictions, the technique is considered a criminal act, and the perpetrators could face both civil and criminal penalties. Despite this, it can be difficult to prove alarmingly low prices or unfair features were intended to mislead or deceive consumers.

As such, it is up to consumers to remain vigilant when buying products or signing up to promotional deals. Some warning signs that might indicate bait and switch include overly-complicated fine print, limited quantity available, or an offer that seems too good to be true. If in doubt, it is best to obtain independent advice before signing on the dotted line.

By being aware of the signs of a bait and switch scam, consumers can protect themselves from these unethical practices and ensure they don’t fall foul of them. Most reputable businesses would not use deceptive tactics to mislead customers, so paying close attention to offers from unfamiliar sources can help protect people from falling victim to this scam.
