The government countered all the arguments raised in the appeal, stating that the court made the right decisions throughout the trial and was not biased against Bankman-Fried. They argued that there was overwhelming evidence of fraudulent intent and that Bankman-Fried intended to cause loss to the victims. The government also addressed Bankman-Fried's arguments regarding the exclusion of evidence during the trial, stating that the judge was correct in his rulings. Bankman-Fried now has until January 31 to reply to the government's response. Legal experts believe it is unlikely for the appellate court to grant a retrial. Meanwhile, FTX is planning to repay customers with 98% of refunds likely to be distributed within the next three months.
