They are especially popular when dealing with high-priced or distressed properties, when a buyer may not be able to get approved for a mortgage loan. Land contracts are also commonly used when a buyer or seller wants a quick turnaround, and when a bank may not be willing to exchange the paperwork.
In most cases, terms of land contracts involve a large down payment, interest and a repayment term that can last anywhere from a couple of years to over a decade. Buyers are responsible for making their payments on time, as well as maintaining and insuring the property until the debt is fully paid off. Sellers typically require buyers to sign a land contract which outlines the terms, conditions, and payment methods of the agreement. They are also responsible for filing any paperwork that is required in order to keep the title to the property in their name during the contract period.
Once the last payment is made and the debt is paid off, the seller will transfer legal title of the property to the buyer. At this point, the buyer can apply for a conventional loan from a bank and close on the sale, thereby receiving official title and ownership of the property.
Overall, land contracts are a great way to structure a real estate transaction for someone unable to qualify for a conventional loan. They allow both the buyer and seller to feel secure during the transaction by outlining the rights and responsibilities of both parties. If properly structured and executed, a land contract can be a very beneficial agreement.
